OBJECT

These Terms and Conditions govern the legal relationship arising from the purchase-sale process formalized by the Customer through the Website (PIBUPETS.COM).

These general conditions of sale shall govern the purchase of any product (the “Products”) listed on our website.

The Products are offered for sale exclusively to direct users who, under Royal Legislative Decree 1/2007 of November 16, 2007, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws (the “TRLGDCU”), are considered consumers (the “Customers”). Consequently, some categories of potential buyers will not be able to purchase the Products, such as those whose purpose is to resell the Products to third parties, for example retailers/traders, wholesalers, resellers, professionals, etc.

Each purchase transaction is governed by the provisions of the TRLGDCU, Law 34/2002 of July 11, 2002, on Information Society Services and Electronic Commerce and other applicable regulations, as well as by these conditions of sale, published in the Conditions of Sale link on the Website. Unless otherwise indicated, the Customer may make the purchase transaction in the same language in which these conditions of sale are written. These conditions of sale have been drawn up by Felícitas Medina Alamillos, (hereinafter, “PIBUPETS.COM”), which is the sole contractual partner of the Customers and which assumes the obligation to satisfy the orders of Products. Felícitas Medina Alamillos maintains this activity in accordance with Spanish law, and has its registered office at the following address:

DURATION OF THE PURCHASE CONDITIONS

The period of validity of the offer and the price of the Products shall correspond to the time during which they remain published on the Website, except for typographical errors, so that PIBUPETS.COM reserves the right to modify these conditions of sale in the future. In such case, the amended conditions of sale shall be valid and enforceable only with respect to orders that the Customer submits after such revised conditions are published on the Website. Consequently, PIBUPETS.COM invites the Customer to review the most recent version of the conditions of sale before placing an order.

ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The Customer, by sending his order, unconditionally accepts and agrees to respect these conditions of sale in its relations with PIBUPETS.COM, also declaring to have the status of “consumer” within the meaning of the TRLGDCU. The Customer acknowledges that PIBUPETS.COM is not bound by conditions of sale other than those set forth herein, unless otherwise agreed in advance and in writing.

CUSTOMER COMMITMENTS

The Customer expressly accepts the full and unreserved adherence to these conditions of sale, in the version published by PIBUPETS.COM at the time the Customer purchases the product in which he is interested. Therefore the Customer agrees to carefully read the conditions of sale, each time he proceeds to the purchase of any product, since they may have been subject to change since the last time he accessed.

By means of the acceptance of the present General Conditions of contracting the Client declares:

– That he/she is a person with capacity to contract.
– That he has read and accepts the present general conditions of contracting.

The Buyer will have access always and in any case, prior to the start of the procedure of purchase of products, to these General Conditions of Sale, being able to be stored and / or reproduced on a durable medium.

The Consumer acknowledges that the contract of sale of Products is perfected when the purchase procedure is completed; likewise the Customer acknowledges that it is at that moment when the Customer becomes obliged to pay the final purchase price of the Products purchased, which will include all applicable taxes and will break down the additional expenses incurred during the purchase process.

PIBUPETS.COM reserves the right to modify the prices of the products published on the aforementioned Website when it deems appropriate and making it visible on the Website. All materials included on the Website (including but not limited to all images, text, trademarks, logos or other distinctive signs) belong to PIBUPETS.COM or third party licensors and are protected as works subject to intellectual or industrial property rights.

Consequently, the Customer may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available, or allow access to the public through any form of public communication of any of the elements referred to in the preceding paragraph, without the prior written permission of PIBUPETS.COM or the legitimate third party holder of the corresponding rights.

The Customer shall use the Products only for its own needs, and undertakes not to make any direct or indirect commercial exploitation of the materials, elements and information contained therein. Infringement of this clause may lead to the initiation of legal action, both civil and criminal, against the offender.

FORMALITIES TO ENTER INTO THE PURCHASE CONTRACT

The Customer must register as a user on the website, must have an email address and provide truthful and accurate data; being the customer responsible for all activity on your account. Your account may be terminated if it is used to carry out activities that violate these terms and conditions.

The contract is concluded in English, in accordance with these Terms and Conditions.

The offers will be valid for the period specified in each case on the Website.

The Client will be able to consult the essential characteristics of each product through its description on the Web Site.

To purchase on the Website you will be asked to follow the steps below:

Select the desired Product. – Login or Register as a new user. – Enter your user details or create your account if this is the first time ordering on the website.
Confirm shipping information.
Selection of payment and shipping method – The final price depending on the additional services selected will be shown automatically. This final price will include transport costs as well as other possible costs indicated during the purchase procedure.
Confirmation of the purchase.

OBLIGATIONS OF PIBUPETS.COM

PIBUPETS.COM, undertakes to comply with the following contractual obligations arising from the business relationship with the Customer as a result of the hiring of services by the same:

To provide with the maximum guarantees to the Client, the service requested by the latter in accordance with the provisions of the contracting conditions, without breaching the contractual good faith.
To expressly inform the Client of the existence of the present conditions prior to the beginning of the contracting procedure.
To inform the Client prior to the contracting and in a concrete, clear, precise and unequivocal manner, of the specific characteristics of the services requested, such as the price of the same and the applicable taxes.

OBLIGATIONS OF THE CLIENT

For its part, the Client undertakes to:

Carry out the full compliance with the provisions of these conditions of the services provided by PIBUPETS.COM.
Complete the registration forms prior to the start of the recruitment procedure with accurate and current information.
Provide the correct bank details requested by PIBUPETS.COM.
Pay the price of the products purchased, without the filing of a claim exempts you from this obligation.

RIGHTS OF THE CUSTOMER

All information provided to the customer shall have the character of binding for the offeror under the terms established by the legislation in force.

Every Client has the right that the goods purchased are of the contracted category and legal requirements or of that quality which is in direct proportion to the category of the product.

DELIVERY OF THE PRODUCTS

PIBUPETS.COM will deliver the Products purchased at the address indicated by the Customer, but only when it is an address located within the Spanish territory with the exception of Ceuta and Melilla. PIBUPETS.COM guarantees the delivery of the order within the indicated time, depending on the geographical area or the chosen service, provided that the products are in stock and with the quality that we guarantee in all our items. The shipping cost varies depending on the transport service chosen and the destination location and can be consulted at any time during the purchase process. Orders received on Saturdays, Sundays and holidays will be considered received on the first working day after that day.

PRODUCTS OUT OF STOCK

If the Products are not in stock, this circumstance will be shown on the Website and the Customer will not be able to place his order until the Products are in stock and available for shipment. If PIBUPETS.COM detects, upon receipt of the Customer’s order, that a Product is out of stock, PIBUPETS.COM will notify the Customer and will refund the payment made by the Customer if he decides not to wait for the restocking.
The delivery schedule and the corresponding costs will depend on the availability of the Product, the shipping methods and the courier in question.

The risk of loss or damage to the goods is transferred to the customer from the time of delivery to the customer’s address.
PIBUPETS.COM is NOT responsible under any circumstances for any damage caused by the misuse of the goods.

WARRANTIES AND DEFECTIVE PRODUCTS

All products marketed by PIBUPETS.COM comply with the Consolidated Text of the General Law for the Defense of Consumers and Users RDL 1/2007 of November 16, 2007; for all matters not covered by that legislation, to the specific provisions of the Spanish Civil Code that are applicable to these issues.

If the product does not conform, the Customer may demand the replacement of the product, unless it is objectively impossible or disproportionate.
The receipt must always be presented in order to exercise the product warranty.

For any questions, doubts or incidents related to the products offered by PIBUPETS.COM, the customer must contact PIBUPETS.COM. The email must contain the purchase invoice, the defective Product and a description of the defect discovered, as well as the customer’s personal data. Once the email is sent, the Customer will receive by email a written response and a summary with the information necessary to execute the warranty. This is the only way to obtain the replacement, repair or refund of the defective Products.

The defective Product will be returned to PIBUPETS.COM in a sealed package, at no cost to the customer, sent to the address indicated in the first clause of these conditions of sale.

PIBUPETS.COM reserves the right to verify the reality of the defect. Only after such verification PIBUPETS.COM will proceed to replace, repair or refund the Product, as appropriate.

It is understood that the products are in conformity with the contract provided that: they conform to the description made by PIBUPETS.COM and possess the qualities presented therein; they are fit for consumption, and present the usual qualities of a product of the same type and that they are fundamentally expected from the same. When this is not the case with respect to the products delivered to the Customer, the Customer shall proceed as indicated in the Returns section. However, some of the products that are marketed in PIBUPETS.COM, could present non-homogeneous characteristics as long as these are derived from the type of material with which they have been manufactured, and therefore will be part of the individual appearance of the product, and will not be a defect.

RIGHT OF WITHDRAWAL

All purchases made on the Website are governed by the provisions of the TRLGDCU relating to distance contracting. In particular, the Customer has the right to withdraw from the contract for the purchase of Products, without incurring any penalty or charge and without any obligation to communicate the reasons for such withdrawal, within 15 (fifteen) calendar days from the date of delivery of the Product.

The right of withdrawal can be exercised by requesting it in two ways, either by mail sent to the registered address of PIBUPETS.COM or by email.

The email must include the purchase invoice, customer contact details, the make and model of the Product to be returned and, at the discretion of the Customer, a brief description of the reasons for withdrawal. Once the email has been sent, the Customer will receive by email a reply from PIBUPETS.COM.

The Product to be returned must be sent to the postal address of PIBUPETS.COM, in a sealed package and addressed to the address indicated in the first clause of these conditions of sale.

PIBUPETS.COM will accept without delay the return of any Product, provided that it is in perfect condition, and complete (packaging, instruction manual) and that the right of withdrawal has been exercised in accordance with the terms and conditions mentioned above, and will refund all amounts paid as soon as possible within 14 calendar days of receipt of the product at our premises. In the case of cosmetics, in order to exercise the right of withdrawal it will be necessary to return the Product in its original packaging still sealed. The Customer will be responsible for any diminished value that an improper handling of the product may cause to the returned product.

The return of any opened cosmetic product will not be accepted. All products marketed by PIBUPETS.COM comply with the provisions of RDL 1/2007 of November 16, 2007, revised text of the General Law for the Defense of Consumers and Users.

ERROR IN THE SHIPMENT

In the case of an erroneous shipment, PIBUPETS.COM will be responsible for the collection of the product (exclusive service peninsula and Balearic Islands) and will proceed to the correct shipment at no cost to the customer once the wrong product has been delivered to our warehouse, provided that the incident is communicated within 7 days from the date of purchase, via email.

REFUSED PRODUCT

If for reasons not attributable to PIBUPETS.COM or to the transport agency, the order is refused by the customer, PIBUPETS.COM reserves the right to claim from the customer the shipping costs for standard shipping. The payment of these costs will be charged either to the credit card with which the purchase was made, or by any other means subsequently agreed with the customer.

CANCELLATION OF ORDERS

PIBUPETS.COM reserves the right to cancel orders or certain Products of an order if any of the following circumstances occur:

– Products qualified as unavailable or out of catalog by distributors.
– Products that cannot be delivered by the suppliers due to problems beyond PIBUPETS.COM’s control.
– Fraud related to credit card.
– Incorrect use of discount coupons.
– Fraud against PIBUPETS.COM.

PIBUPETS.COM will inform the Customer about the cancellation of any order and will refund all amounts paid for such order within 30 calendar days.

PRIVACY

PIBUPETS.COM adopts security measures in the processing of data that offer the highest level of confidentiality for its Customers, in full compliance with Spanish regulations on protection of personal data. The legal notice regarding the processing of personal data is available in the Privacy Policy, to which we refer for all matters relating to the protection of personal data. By placing an order through the Website, the Customer expressly agrees that his or her personal data will be processed as described in the privacy notice.

APPLICABLE LAW AND JURISDICTION

The present conditions of sale and all orders shall be governed by Spanish law. PIBUPETS.COM is not subscribed to the Consumer arbitration system. The courts of Seville shall have exclusive jurisdiction over any dispute that may arise in connection with the validity, interpretation or application of these conditions of sale and any order.
